Malta Gaming License

The Malta Gaming Authority (MGA) has been created to oversee all types of gaming in Malta, including gaming remotely and online. In 2004, the Remote Gaming and Gambling Regulations entered into force, making Malta the first EU Member State to introduce legislation related to internet-based gaming. This remains applicable to this day and is considered one of the greatest milestones in internet-based gaming.

The MGA's remote gaming framework is technology and game-neutral, accommodating any form of gaming delivered through distance communication channels, including internet, digital TV, mobile technology, and telephony. Gaming products offered through these channels, managed securely and in compliance with the Regulations, are eligible for MGA licensing consideration.

The Regulations have been organized into four classes of licenses depending on the kind of activities being selected; both Business-to-Consumer (B2C) and Business-to-Business (B2B) operators. Every class discusses a unique gaming market from casino and games of chance solutions through to P2P gamers and B2B gaming software.

Permissible Structures

Physical Office Requirements

There is a requirement for the registered company to have a physical office in Malta for regulatory oversight and to have a presence in the country.

Capital Requirement

It is required to show financial stability by having paid-up capital of €40,000 to €100,000, depending on the license class.

Directors & Shareholders

Minimum two directors and two shareholders, no residency restrictions for directors. International ownership structures are possible.

The holders must keep their key management and servers, crucial elements for an online gaming platform, based in Malta during the duration of the licence.
